San Bernardino, CA – Former high school wrestler, Seth Michael Whisner, 20, has been found guilty of violating his parole related to his conviction for having unlawful sex with two teenage girls.
Judge Victor Stull indicated in Friday’s court hearing that that he had read and considered the probation officer’s report and, after hearing arguments from Whisner’s attorney David Menezes and prosecutor Simon Umscheid, revoked probation and then reinstated the five years of supervised probation imposed when he was sentenced earlier this year.
WHAT THE DECISION MEANS
Judge Stull’s decision means Whisner will serve the equivalent of 365 days in jail.
As of Friday, Whisner — who is incarcerated at the West Valley Detention Center in Rancho Cucamonga — had served 114 days in jail. However, he was given credit for good behavior of an additional 114 days for a total of 228 days. That would mean he has 137 additional days to serve.
But again, Whisner is expected to be released about the end of October, should he get credit for good behavior. The balance of the time would be served on weekends.
Judge Stull admonished Whisner to not miss a weekend.
THE VIOLATION
Whisner was arrested July 25, when he violated his parole by logging on to his Facebook account — which is now no longer available – he posted comments about his status and identified his two victims, aged 17 and 15.
In addition to having no contact with his victims, Whisner was originally ordered by Judge Arthur Harrison, when he sentenced him on July 23 to five years of probation, to not maintain any social media accounts and have no phone with Internet access.
NEXT COURT APPEARANCE
Whisner’s next court appearance is scheduled for 8:30 a.m. in Department S-24 on Monday, October 28, for possible modification of jail time. (711)
